Lawrence O’Donnell refers to one word in Trump’s plea to get rid of the game

Published

“I want my documents back!”

Donald Trump, This Morning, 10-5-22, on Truth Social, Letter to the National Archives.

There are a few areas in Trump’s legal motions and briefings in Florida that Trump’s attorneys have consistently avoided in court filings. While Trump has been on social media and in interviews suggesting that the FBI planted evidence and claimed to have declassified the documents, his lawyers suggested no such “excuses” in a memo they signed. They know better. A lawyer can and will be punished for asserting unfounded questions or theories. Another thing Trump’s lawyers never wrote down was that Trump was in possession of these documents. Despite the fact that Trump clearly I had had Possession of files (see above – wants to recover them), never appeared in a legal file. Admitting Trump’s possession, in effect, is admitting the crime.

But last night, in an effort to get SCOTUS to hear the 11th Circuit’s appeal, the attorneys made a mistake, perhaps in a hurry and without attention to detail. They said Trump had the documents.

Lawrence O’Donnell noted this on his show:

In their appeal today, Trump’s lawyers are still No reason was given whatsoever for Donald Trump’s right to obtain these documents They made a mistake in using a word they had not used before.

In describing Donald Trump’s relationship with these documents, after saying in their appeal to the Supreme Court tonight, once again, that this case, “Basically a dispute about document storage,Trump’s lawyers, on page 30, went on to say that The government has sought to criminalize President Trump’s possession and administration of his personal and presidential records.”

“Possession of these records is a crime.”

Taking legal action to the extreme by saying Trump “entitles to it” may sound somewhat different than admitting possession. It’s not, especially when considering potential criminal charges. The defendant does not want to admit every element of the crime: knowledge, intent, and commission of the crime. Possession goes to committing the crime.

As O’Donnell said:

Which is why Donald Trump’s lawyers have avoided that word, possession. But on page 30 of their dossier submitted to Clarence Thomas tonight, Trump’s lawyers stepped in.

In every file Trump’s lawyers filed in this case, they’ve been trying to suggest that the former president’s possession of the documents is perfectly legal without ever using the word “possession.” But tonight, they did,”

Needless to say, the only last place Trump’s lawyers might ever want to lose track of is a request to SCOTUS to hear their appeal.

When one has a client “acting” guilty, it’s hard to dance around their absurdity. One must be vigilant not to “interfere”.
